Our Legal Services DISOLUTION OF MARRIAGEIn California there are four types of divorce proceeding. Depending on your situation, you will proceed with one of the following categories; Summary Dissolution, Default, Uncontested, Contested. In all cases, except summary dissolution, spousal support, child support and child custody issues will be determined during the proceeding and must be entered into an agreement signed by both parties called the Marital Settlement Agreement. All provisions agreed upon in this agreement shall collectively be entered into the final Judgment, and once obtained the signature of the Judge, it becomes your final divorce decree.Summary Dissolution: A Summary Dissolution is available to couples that have been married less than 5 years, have little or no assets and debts, and have no children from the marriage. In addition, there must be a settlement arrangement to which both parties agree. This is a simple divorce process provided the parties agree to all aspects. Default: This is the process by which the person who initiates or files the first papers to dissolve the marriage (Petitioner), serves the other party (Respondent) and the Respondent chooses not to file any responsive papers with the court. The Petitioner is required to file certain documents to eventually obtain a judgment. Uncontested: This is the process by which the person who initiates or files the first papers to dissolve the marriage (Petitioner), serves the other party (Respondent) and the Respondent files and serves the responsive papers with the court. The process is uncontested when both parties agree to the terms of the settlement. This agreement includes the division of assets, debts and property, and child custody arrangements. The court will determine the child support arrangements. Contested: This is the process by which the person who initiates or files the first papers to dissolve the marriage (Petitioner), serves the other party (Respondent) and Respondent files and serves responsive papers. The process is contested when both parties disagree to the terms of the settlement and terms must be negotiated or ordered by the court. LEGAL SEPARATION
The Legal Separation process proceeds in the same manner as an uncontested dissolution, where both parties agree to the terms of the settlement. However, the parties will remain legally married.* POST - JUDGMENT MODIFICATIONMany times circumstances make it necessary to change an existing court order. We can prepare the required documents to request a change to an existing divorce judgment. Order to Show Cause: We can prepare the necessary forms to request changes to Spousal Support, Child Support and Child Custody.

For example, you could change your name to restore your name after divorce, amend a birth certificate, or other legal document. You may also change your name for religious or political reasons.
